Grounds for Obtaining a Residence Permit

Where to invest? Most often, foreigners decide to invest in real estate (residential or commercial premises), company vehicles or office equipment. However, the company founder may also opt for any fixed assets that will subsequently help in realizing his or her business goals.
What are the deadlines? To fulfill the business activity requirement, such investments must be made within the first six months from the date of legal entity registration. This is one of the fastest and most independent ways to obtain a work and residence permit in Slovenia.
Why to invest? The purchase of fixed assets means that the company founder is planning its future, connects the development of its business with Slovenia, and is ready to concentrate the centre of its business interests here.
When to apply for a residence permit? Once the transaction(s) for the acquisition of fixed assets is completed, the foreigner has the right to apply for a work and residence permit based on the fulfilled activity condition.
Important to consider! It is important that only one person can benefit from obtaining a residence permit through investments in one company. It is also necessary to submit documents for a residence permit before the end of the six-month period after legal entity registration.

Employment of an EU citizen for a period of at least six months
What is needed? The second option is to employ an EU citizen on a full-time basis for a period of at least six months. Unlike third-country nationals, EU citizens have free access to the labour market. The employing company will have to register employees with social security funds, regularly transfer the necessary taxes and fees, and pay out salaries. The minimum salary rate in Slovenia for 2024 is 1253,90 EUR before taxes.
How to get a residence permit? After at least one employee has worked for your company for 6 months, you can apply for a single work and residence permit (RP) at the Embassy of the Republic of Slovenia in your country of citizenship. This condition can be used at any time during the company’s operation by confirming the full-time employment of a local employee 6 months prior to applying for a residence permit. At the time of submitting a foreigner’s documents for a residence permit, the company should not have debts on taxes and wages, and all necessary accounting reports have been submitted.

10,000 EUR of income monthly for six consecutive months
What do you need? If your company has sufficient turnover, you will be able to apply for a residence permit for one foreigner based on the fulfillment of this condition. It means that your company must have monthly income from its activities into its current account in the amount of at least 10,000 € per month for 6 consecutive months. Please note that it is not the total income for 6 months that is considered, but the income in each month separately.
How to get a residence permit? Once the company fulfills this condition, it has the right to apply for a single work and residence permit for one employee. This condition is in demand for an existing business that is relocating to Slovenia and transferring existing turnover to a Slovenian legal entity. This condition can be used at any time during the company’s activities by showing the turnover for the 6 months of work preceding the application for a residence permit.

Employment based on a university diploma
What conditions? If a foreigner has a higher education, he has the right to work in his own company as an employee. In this case, the company must create a vacancy and submit it to the Slovenian Employment Service, obtain consent to employ a foreigner and then submit documents for a residence permit.
What do you need? The company must have a local representative on whose behalf the company will submit such a vacancy. The submitted vacancy must be unique – local specialists should not apply for the specified position.
What is the convenience? The company does not need to make investments or wait six months to fulfill the conditions for the active operation of the company.
When can I apply for a residence permit? After receiving Employment Consent from the Slovenian Employment Service, a foreigner is given 30 days to submit documents for a residence permit, during which he must submit a complete package of documents at the Slovenian Embassy in his country of citizenship. If there is a local director, a package of documents for a residence permit can be submitted in Slovenia.

Who can register a company?
Any foreigner can become a founder of a company in Slovenia. In Slovenia, there is no obligatory requirement to have a local citizen as a founder, and you are also not required to have local citizens as employees.
What are the deadlines for registering a company?
After submitting documents, the period for legal registration is up to 10 days. Usually within a week you will receive all registration documents.
How quickly are residence permits issued to businessmen? Do they have priority?
The period for issuing a residence permit in any case is currently at least 3 months. Priority is given to students, highly qualified specialists, and truck drivers. Businessmen are considered on a general basis and the period for consideration of such cases usually depends on the workload of the administrative unit in charge.
Is it possible to make an investment in a company in the amount of €100,000 and obtain a residence permit for two persons (50 + 50)?
The condition for the company activity in investment can be used only once and a residence permit can be applied for only one person. This means that if you have purchased a warehouse for €52,000 or a hotel complex for €700,000, in both cases, only one representative of the company can apply for a residence permit. The transaction amount must simply exceed €50,000.
What are the advantages of a business residence permit over other types of residence permit?
First of all, this is your self-employed independence. The opportunity to launch your own business in Europe and be able to develop it at your own pace. Slovenia is one of the few countries that does not require a certain level of annual income. The residence permit obtained for business purposes does not require you to stay in the country year-round if it is necessary for your work. Unlike a student residence permit, before obtaining a permanent residence you need to live in Slovenia for at least five years (one year per one year).
